Heuking Kühn Lüer Wojtek successful for Swiss Migros in EU merger control proceeding

Heuking Kühn Lüer Wojtek has successfully represented the Swiss retail group Migros in an EU merger control proceeding concerning the acquisition of the German supermarket chain tegut. The European Commission has published its clearance decision shortly before Christmas 2012. The Migros group acquires from the tegut group the retail branches, the group’s headquarters in Fulda and the logistics.

The Migros group is the largest retail company in Switzerland. The company has outlets in all Swiss cantons and the neighbouring countries and controls in addition a large number of subsidiaries in Switzerland and the EU.

The tegut retail business belongs to the company Gutberlet Stiftung & Co. KG whose main seat is in Fulda. 6,2000 employees distribute mainly food products in more than 300 branches in Hessen, Bavaria, Lower Saxony, Rhineland Palatinate, Thuringia and Saxony-Anhalt.
