Legal Security For The Site Of The Parent Company Industrial Plant Of A Leading German Corporation

One of Germany's largest companies has its parent industrial plant in a large town in Eastern Westphalia. Built in 1907 and functioning ever since, the plant is located on a plot of land near the town center which, in the course of the past few years and decades, has seen the steady encroachment of housing estates and other industrial developments. The modern production facilities of our client company operate to high environmental standards and had to be provided with a secure long-term legal framework so that requisite future extensions of the plant may be built on the free spaces still available on the plant site. In this highly complex scenario, Heuking Kühn Lüer Wojtek first acted as legal counsel to the mandatory town and city planning inquiry on the development of an urban planning model and an urban development skeleton plan. Moreover, we acted as legal counsel for the development and finalization of the land development plan, for whose management we were also largely responsible. In this context, we had to provide solutions to some highly contentious issues of emissions control relating to companies which neighbor the site.
