Privatization of sovereign obligations

Heuking Kühn Lüer Wojtek provides continuous advice to a number of cities, State districts, and public utilities in the restructuring and/or (partial) privatization of their utility supply and waste disposal companies (including those for water, wastewater, and waste). This includes:

  • Reorganization of household waste disposal in order to fulfill the requirements of the technical decret for waste disposal site (TA Siedlungsabfall) as of June 1, 2005, including extensive support in the successful tendering procedure
  • Development of construction codes for establishing waste incineration facilities
  • Planning and executing transfer of community disposal operations such as collection and transport of waste to a public utility company, municipal undertaking, statutory body, or private firm
  • Continuous legal advice to public utility companies including advice on questions of price and public fees
  • Legal structuring of services to be remunicipalized
  • Comprehensive assistance to municipalities in all phases of privatization of operations and transfers to private companies, including their obligations to provide investments in public facilities
