Legal Position of the Hanseatic City of Hamburg Strengthened Regarding Elbe Philharmonic




For more than two weeks, the Elbe Philharmonic Project has been in the headlines, due to construction company HOCHTIEF asserting additional demands in the three-digit million range. Previous negotiations failed to lead to an agreement between the City and the construction company.

However, politicians do not exclude a collapse of the negotiations. Therefore, State Council member Reinhard Stuth has had the contract package of the Elbe Philharmonic reviewed externally. The WELT newspaper of September 19, 2008 quotes him as follows: "In the contract, which we have had reviewed once again, and which is assessed as very good, there is no opting-out clause, but in such an event an arbitrator proceeding would be commenced. For both sides, that would be protracted and expensive."

Dr. Ute Jasper from the Düsseldorf office of Heuking Kühn Lüer Wojtek were responsible for the entire conception and legal monitoring of the award procedure as well as the preparation of the contracts.
