Heuking Kühn Lüer Wojtek supported the insolvency administrator Algari in drafting and negotiating the reconciliation of interests and the social plan for the insolvent bus operator Werner.
By order of Darmstadt Local Court of June 1, 2015, insolvency proceedings were initiated regarding the assets of Bensheim-based public transport company Werner. Fabio Algari, Lawyer at hww, was appointed as insolvency administrator. After it became apparent that the operation would not be viable at the terms of the concession agreements in the long run, insolvency administrator Algari had initially been able to obtain price increases in order to maintain the regional passenger transport operated on the lines on behalf of RMV and VRN. As a further measure, all concession agreements were terminated effective December 12, 2015. In addition, the closure of the entire company as of December 12, 2015 was decided by resolution of the creditors' meeting. Notices of dismissal had to be issued to the remaining 40 employees. From December 13, 2015, the transport services will be continued by other companies, including from the railway group.
Supported by Heuking Kühn Lüer Wojtek, it was possible to conclude on the part of the Works Council and the insolvency administrator a reconciliation of interests and social plan including a list of names within 4 weeks.
