Fact Witness Memory and the Impact of Legal Traditions
 
Heuking Kühn Lüer Wojtek cordially invites you to an online panel discussion as part of the Paris Arbitration Week 2021.

Accurate memory is an important factor for the probative value of witness evidence. In 2021 the ICC Commission of Arbitration and ADR launched a Report on “The Accuracy of Fact Witness Memory in International Arbitration”. The Report describes the work of the interdisciplinary Task Force “Maximising the Probative Value of Witness Evidence” including a review of scientific literature relating to memory and witness evidence by Dr Ula Cartwright-Finch and Dr Kimberley A. Wade. The Report analyses the effects of current practices on witness memory and contains proposals that can help to avoid distortion of witness memory.

Following an introduction by Ula Cartwright-Finch, the (former) Chair and Vice-Chair to the ICC Commission of Arbitration and ADR, Christopher Newmark, and the Co-Chair of the Task Force, Ragnar Harbst, will discuss with us the impact of different legal traditions (written witness statements, cross examination etc) and the way in which international arbitration standards may develop further in the future to enhance the probative value of fact witness evidence.
