Product designations and logos, three-dimensional forms of goods or packaging or melodies, if they are sufficiently distinctive, can be protected as trademarks. Heuking Kühn Lüer Wojtek does research for you on any conflicting prior marks of third parties, assists you in the design of your trademark and the definition of the goods and services for which it should be protected and registers your trademark for you nationally and internationally at the competent trademark offices. In doing so, we work together with specialized correspondent offices, which frequently are members – as we are – of the Global Advertising Lawyers Alliance. We also assume the administration of your trademark including the monitoring of conflicting new applications by third parties and the monitoring of the terms of protection. We prevent violations of your trademark by identical or similar product designations by third parties with warning letters and, where required, with legal action including motions for preliminary injunctions or civil complaints before the competent chambers for resolving mark-related disputes.

Heuking Kühn Lüer Wojtek also advises and represents you in the design and defense of your company symbols – whether they be corporate names, corporate logos, or establishment designations. These marks are protected by the Trademark Act just as trademarks and can be defended as well, but can conflict with older mark rights of third parties. Before you finally decide upon your corporate name, we carry out a search for you for marks in order to avoid such conflicts to the extent possible. If desired, we monitor the Commercial Register for conflicting new corporate entries by third parties and take action against these with a warning letter, motion for a preliminary injunction or lawsuit.

Your work titles are also protected by the Trademark Act against imitators. Heuking Kühn Lüer Wojtek provides you with support from the outset – we advise you during the design of your work title, research conflicting older titles of third parties and if desired have notifications of title protection placed for you. If a conflicting earlier title is used by a third party, we take action with a warning letter, motion for a preliminary injunction or lawsuit.
