Plant Variety Protection Law

Plant Variety Protection Law protects certain plant varieties and thereby breeders or discoverers of such varieties in the exercising of rights to plant varieties. Plant variety protection establishes an exclusive right that is in some ways comparable to patents and thus also protects intellectual property. Any breeder or discoverer of a new plant variety may apply to the Federal Office of Plant Varieties for protection of the plant variety on the basis of the Federal Plant Variety Protection Act. He thereby establishes an exclusive right to place on the market for commercial use, to produce or to import reproducing material (plants, plant parts including seeds) of a protected variety. Therefore, issues are concerned that are also of importance in the entire field of intellectual property law.
