The "Monheimer Modell"

Our lawyers developed the legal model for the then largest Public-Private Partnership (PPP) in Germany involving the renovation, maintenance and administration of all schools and gymnastics and sports halls in the town of Monheim am Rhein.

Our first role was to offer legal support for the implementation of various feasibility studies. We then acted as principal legal counsel for the due process of the extensive pan-European invitation-to-tender designed to locate the most suitable private partners (competitive bidding and negotiation procedures). The model was successfully implemented in an eight-month period beginning with its ratification by the Town Council of Monheim am Rhein and ending with an award of the contract, uncontested by auditing procedures or civil lawsuits.
