Vivantes - Purchasing Collaboration

Vivantes Netzwerk für Gesundheit GmbH (Vivantes) was seeking contractual collaboration with Einkaufs- und Logistikgesellschaft mbH (ELG) for the hospital sector.
 
The objective of this contractual collaboration between ELG and Vivantes was the achieving of particularly attractive prices and terms on procurement for the hospital network, which was to lead to an efficient and economical use of funds in procurement.

Vivantes asked us to submit a comprehensive legal opinion on the possible contract designs of the membership in a purchasing alliance and to review compliance of the various forms of collaboration under public procurement law. Our legal opinion presented the various models of admissible purchasing collaboration and evaluated those models, particularly in terms of their admissibility under public procurement law.
