Heuking Kühn Lüer Wojtek Successful in Contract Award Review Proceedings Before the Rhineland-Palatinate and Hesse Public Procurement Complaint Boards

Heuking Kühn Lüer Wojtek was again able to successfully conclude several contract award review proceedings:

The Rhineland-Palatinate Public Procurement Complaint Board determined that the exclusion of a bidder from contract award proceedings for the reconstruction of the Nackenheim regional school into a four-track eight-year secondary school with full-day operation was unlawful. The Public Procurement Complaint Board obligated the contracting authority to include the bidder in the proceeding again and to continue the proceeding with the bidder.

Heuking Kühn Lüer Wojtek was also able to reach the inclusion of the bidder in the further contract award proceedings for another construction project. Bids had been invited for the new construction of an office and administrative building with an investment volume of about EUR 55 million. The bidder had initially been excluded. The Hesse Public Procurement Complaint Board held the exclusion to be unlawful. The contracting authority thereupon reinvolved the bidder in the proceedings.
