Due to the high pollution levels in German inner cities, numerous German states and cities are being sued by residents and environmental organizations before the administrative courts to take appropriate measures to reduce immission.
Dr. Wolfram Sandner, Partner at Heuking Kühn Lüer Wotjek’s Stuttgart office and specializing in environmental and planning law, has represented the state of Baden-Württemberg in such litigation since 2005.
Currently, the issue is still about excessively high values in Ludwigsburg. Dr. Sandner is representing the state in the appeal proceedings before the Federal Administrative Court in Leipzig. One of the issues in the case is whether traffic bans can be imposed specifically on diesel vehicles if the legal limit value for nitrogen dioxide can also be achieved with other, less burdensome measures, or what requirements must be placed on the official forecasts predicting that the limit value can be achieved in this other way.
