Civil service pensions with “sustainable” shares – Heuking Kühn Lüer Wojtek supports Baden-Württemberg, Hesse, and North Rhine-Westphalia

The German states of Baden-Württemberg, Hesse, and North Rhine-Westphalia are jointly restructuring their pension funds’ equity investments. They will invest some EUR 7 billion in sustainable equities.

The states are looking for a service provider throughout Europe that will construct and maintains two stock indices (Eurozone and World ex Eurozone). In construction and maintenance of the stock indices, sustainability criteria and various specifications, such as no production of controversial weapons, no production of nuclear energy, are to be taken into account. The announcement was published in the EU Official Journal a few days ago.

The state of Brandenburg is also considering investing in these stock indices. It reserves the right to join the current invitation to bid as a contracting authority.

Heuking Kühn Lüer Wojtek structures and supports the project with Dr. Ute Jasper (Lead), Dr. Christopher Marx (Procurement and Contract Law), Dr. Christoph Gringel and Dr. Thorsten Kuthe (both Contract Law and Capital Markets), and Gesa Krohn (Procurement Law). In the past, Dr. Jasper's team has successfully concluded numerous proceedings for the state of Baden-Württemberg, including the award of billions in public transport contracts and the new invitation to bid for food and restaurant services at Wilhelma in Stuttgart.

The Public Sector & Public Procurement department led by Ute Jasper has been one of the three best procurement law practices for years. Since 1991, it has advised on awards, restructuring, large-scale projects, and cooperations in the public sector and has accompanied several hundred large-scale projects of the federal, state and local authorities and their subsidiaries with a total volume of more than EUR 20 billion without any procedures having been successfully challenged.

She advises federal and state ministries, municipalities, and businesses, particularly on innovative and complex projects. Ute Jasper heads Heuking Kühn Lüer Wojtek's "Public Sector & Public Procurement" department. For years, she has been ranked number 1 in JUVE Handbook of Commercial Law Firms 2017/18 and according to “Law Firms in Germany,” is the "premier contact on the market" for infrastructure. In October 2016, she received the JUVE Award for Regulated Industries with her team.
