Patent Law: Heuking with C&F again successful for EGGER

Dr. Anton Horn and Dr. Sabine Dethof, lawyers at Heuking’s Düsseldorf office, successfully represented Egger Holzwerkstoffe Brilon GmbH & Co. KG in a patent dispute. In collaboration with patent attorneys from the law firm of Cohausz & Florack, they now also successfully concluded nullity proceedings before the Federal Court of Justice. EGGER had filed an action for nullity requesting that a patent held by Rehau Automotive SE & Co. on a “Method for producing a decorated profile body” (EP 2 247 451) be declared null and void. EGGER now also prevailed in the second instance.

The decision has an impact on patent infringement proceedings. Düsseldorf Regional Court had previously ruled in a March 20, 2019 judgment that EGGER did not infringe the patent at issue. As a result of the Federal Court of Justice decision, the legal basis for the action now ceased to exist whereupon Rehau withdrew its appeal. Heuking and Cohausz & Florack also represented EGGER in these proceedings.
