Ceremonial keys presented to the state of North-Rhine Westphalia: Heuking Kühn Lüer Wojtek advises builder of Rhein-Waal University of Applied Sciences in Kleve

Düsseldorf-based construction law and public procurement law experts Dr. Peter Kamphausen and Bastian Gierling of Heuking Kühn Lüer Wojtek advised the builder District of Kleve and the district-owned subsidiary, Kreis Kleve Bauverwaltungs-GmbH (KKB), on the construction of the new campus of Rhein-Waal University of Applied Sciences in Kleve.
 
In a ceremony last Friday, the 18 new university buildings with a campus area of seven hectares were solemnly handed over to the North Rhine-Westphalia building and property enterprise by the District of Kleve. In the future, Rhine Waal University of Applied Sciences will offer 25 bachelor and 3 master study courses on the site for about 3,000 students in the fields of natural sciences, economics, engineering, social sciences and health sciences.
 
The project is unique, because for the first time a university was built ready for occupancy by a local authority, the District of Kleve, and then transferred to the state at a firm price agreed at the beginning of the process. "Everything went according to plan: on time and within budget, the University was built in a record time of only two and a half years and now handed over to the state of North-Rhine Westphalia at the firm price of about EUR 126 million," lead lawyer Kamphausen commented on the project that is now concluded.
 
Heuking Kühn Lüer Wojtek had provided comprehensive legal advice to and represented the builder from the beginning on. In 2009, Heuking Kühn Lüer Wojtek started advising on carrying out the urban development and architects' competition, on the awarding of the architect and special planning services, the development planning proceedings and the granting of the building permits. Subsequently, the firm legally advised the builder and KKB also on holding about 60 Europe-wide award procedures. "All of these award procedures were completed without requiring a single contentious decision before the procurement tribunal or in court," lawyer Gierling continued.
 
In addition, Heuking Kühn Lüer Wojtek provided legal advice and represented regarding numerous issues that arose during the construction period on building contract performance towards the commissioned building firms. Finally, Heuking Kühn Lüer Wojtek also advised in connection with contractual handling of the transfer of the buildings by the District of Kleve to the state and to Rhein-Waal University of Applied Sciences.
