Heuking Kühn Lüer Wojtek advises JadeWeserPort Realisierungsges. mbH & Co. KG on asserting claims for damages

JadeWeserPort in Wilhelmshaven is Germany's first deepwater port for large container ships and at a total volume of about EUR 1 billion, currently the largest infrastructure project in Germany. The decision to go ahead with the project was made in 2002. On June 5, 2012, due to cracks in the quay wall and resulting repair work, the opening date had to be postponed by eight weeks to September. The building consortium, insurance company Allianz-Versicherung and political representatives disagree on responsibilities and duties of payment. Heuking Kühn Lüer Wojtek advises JadeWeserPort Realisierungsges. mbH & Co. KG on asserting claims against Allianz and the consortium of builders.

JadeWeserPort Realisierungsges. mbH & Co. KG, held by the state of Lower Saxony and by bremenports GmbH & Co. KG, estimates the loss to be EUR 60 million for the facilities and more than EUR 400,000 per day for a delayed start-up of the port.

This is not the only dispute regarding the construction project. Heuking Kühn Lüer Wojtek has been advising JadeWeserPort Realisierungsges. mbH & Co. KG for two years on defending against claims of about EUR 80 million by the consortium of builders for delaying the awarding of the project.
