Success in regional rail transport competition in Baden-Württemberg with Heuking Kühn Lüer Wojtek

Heuking Kühn Lüer Wojtek supported the German state of Baden-Württemberg in further successful bid advertisements in regional rail transport competition. The state intends to award the contract for 11 of a total of 17 lots to DB Regio AG in a “transitional contract” within the next few days. In four other lots, the approval of Bavarian railway company Bayerische Eisenbahngesellschaft (BEG) as further service provider will still be required.

Due to the favorable pricing of the transitional contracts, Baden-Württemberg saves an average of more than EUR 2.00 per train kilometer, although DB Regio has to use significantly better vehicles than in the past. Compared to the previous prices, overall savings of some EUR 227 million will be achieved.

Supported by Heuking Kühn Lüer Wojtek, Baden-Württemberg advertised numerous transport services for bid in transitional contracts effective as of 2016. "The transitional contracts serve to ensure that advertisements for bids of new vehicle start in a staggered manner so that more railway companies may place bids," said Dr. Ute Jasper, Lawyer and Partner at Heuking Kühn Lüer Wojtek. "It is reassuring to see that competition has led to very good results not only with regard to new vehicle procurement, but also on the short-term transitional contracts," added Dr. Christopher Marx, Lawyer at Heuking Kühn Lüer Wojtek and a specialist for contracts in Jasper’s team.

In the past, the state of Baden-Württemberg had already been able to achieve very good economic results, including significant improvements of the service offering, with the support of Heuking Kühn Lüer Wojtek. The law firm started a large number of other tenders with Baden-Württemberg to comprehensively improve regional rail transport in the state.

In addition to Dr. Jasper and Dr. Marx, the team working on the project included among others Dr. Laurence Westen in public procurement law, Dr. Stefan Jöster in insurance law, and Dr. Thorsten Kuthe and Felicitas Boehm in banking law.

Dr. Ute Jasper is one of the best-known lawyers for public procurement and public infrastructure projects. She advises federal and state ministries, municipalities, and companies. Ute Jasper heads Heuking Kühn Lüer Wojtek's "Public Sector & Public Procurement" department. For years, she has been ranked number 1 in JUVE Handbook of Commercial Law Firms 2014/2015, and according to "Law Firms in Germany" is the "premier contact on the market" for infrastructure.

Dr. Christopher Marx is a lawyer in the "Public Sector & Public Procurement“ Practice Group, Düsseldorf.
